Yaz Class Action Lawsuit

by Steve Fields on August 13th, 2009

Many people are wondering if there is a Yaz class action lawsuit or Yasmin class action against the birth control manufacturer Bayer Healthcare. Currently Yaz and Yasmin lawsuits are being filed by individuals and families throughout the United States. No Yaz class actions have been filed, however given the number of potential Yaz victims, attorneys are looking to multidistrict litigation and class actions to more efficiently handle the growing number of cases. The number of women reporting Yaz and Yasmin side effects such as blood clots, strokes and gall bladder side effects seems to be increasing as consumers become more aware of that their side effects may be linked to this birth control pill.

In July 2009, plaintiffs filed a motion with the Judicial Panel on Multidistrict Litigation seeking to consolidate Yaz/Yasmin lawsuits. The motion requests consolidation of cases where women suffered blood clots problems, heart attack, stroke, kidney failure and gallbladder side effects. If the motion is granted, the consolidated cases are then referred to as Multidistrict Litigation (MDL) which is different from a class action. The consolidated cases would continue to be individual claims, however pretrial litigation including discovery will take place in a centralized location before a single judge assigned to oversee the cases. This helps more efficiently deal with the large number of individual cases that are expected to be filed and eases the burden on the courts. Having cases consolidated into an MDL also helps avoid duplicative exchanges of information from the manufacturer on behalf of each individual plaintiff. This often helps lower the expense of each person who is bringing a claim for compensation.

Yasmin was approved by the Food and Drug Administration in 2001 and Yasmin in 2006 as the first birth control to use the synthetic hormone drospirenone and ethinyl estradiol. Recently, more and more women have been coming forward suffering from serious side effects such as DVT, strokes, gallbladder problems and pulmonary embolisms. Individual lawsuits have been filed on behalf of women living throughout the United States.
